Product Terms and Conditions of Sale

These Terms and Conditions of Sale ("Sale Terms") govern the purchase of goods from our website and apply to all transactions. By placing an order with us, you agree to these Sale Terms. Unless specifically stated otherwise, Products sold are sold by Omni Recovery Pty Ltd (“we / us / our”).

Overview

We sell a variety of products on our website, including compression recovery pants and accessories ("Products"). Please note, our products are not intended for medical grade use.

These Sale Terms apply to all purchases made through the site. If you do not agree with any part of these Sale Terms, please do not place an order.

Ordering

Your order is an offer to purchase Products in accordance with these Sale Terms. We reserve the right to accept or reject your order for any reason, including but not limited to availability Product.

Once you place an order with us, you will receive an email confirmation. Your order is confirmed by us once the Products are dispatched. We will aim to dispatch Products which are in stock within 2 business days of receipt of your order, however dispatch times are subject to fluctuation.

Once you have submitted an order, it can no longer be cancelled or varied.

Prices & Payment

All prices displayed on our website are in Australian Dollars (AUD) and are inclusive of GST unless otherwise specified. Prices are subject to change.

We accept the following payment methods through the shopify portal:

-        Credit/debit cards (Visa, Mastercard, etc.)

-        Afterpay

Payment must be received in full at the time of order, before we dispatch any Products.

Shipping & Delivery

We ship to all Australian states and territories. International shipping may be available on request.

We use third party providers for transport and delivery of Products to you. Any estimates we provide to you in relation to delivery times is an estimate only, and actual delivery times may vary.

Delivery and shipping charges are calculated at checkout.

Returns, Exchanges & Refunds

We hope you love your Products, but recommend that you check they are right for you before placing an order. In addition to your rights under Australian Consumer Law, we do offer a change of mind refund if the Product is not right for you if the following criteria are met:

-        The Product is not used.

-        The Product still has its original packaging.

-        You can provide proof of purchase.

-        You pay postage for the return of Product to us.

-        A $5 handling fee will be charged.

However, if your Product is damaged, defective, or not as described, you are entitled to a remedy under the Australian Consumer Law, including repair of the Product, replacement of the Product, or a refund for the Product.

To request a remedy for a defective Product, please contact us at info@omnirecovery.com.au with proof of purchase and a description of the issue. Once the defect is validated by us the remedy process will follow. Please note that unless otherwise agreed, any return shipping fees and charges will be at your expense.

Warranty

Unless otherwise stated, our Products come with a 12-month manufacturer’s warranty defects in materials or workmanship. This warranty does not cover:

-        Damage caused by misuse or improper care

-        Normal wear and tear

-        Damage caused during shipping if not reported within 48 hours of delivery

This warranty is in addition to your rights under Australian Consumer Law and clause 5 of these Sale Terms.

Limitation of Liability

To the maximum extent permitted by law, we exclude all liability for any loss or damage (direct, indirect, or consequential) arising from your use of our Products, except where such liability cannot be excluded under Australian Consumer Law.

Except where such liability cannot be excluded under Australian Consumer Law, our maximum liability to you for the supply of our Products and sales under this website will be to repair, replace, or provide you with a credit for the Products.

Product Information

We make every effort to ensure that Product descriptions, images, and specifications are accurate. However, slight variations in colour or appearance may occur due to screen differences.

Sizing charts are provided as a guide only. It is your responsibility to choose the correct size based on the information provided.

Products are not intended for medical grade use. If you are suffering from a medical condition, please seek professional medical advice.
